'Punishment was death': Chilling claims emerge in Emmanuel Mbense murder case

The Brakpan Magistrate's Court has heard disturbing testimony regarding the 2022 death of Emmanuel Mbense. Prosecutors allege that the six individuals accused of his murder entered a deadly agreement to ensure no one spoke to the authorities.

Among the group seeking bail is the suspended deputy chief of the Ekurhuleni Metropolitan Police Department, Brigadier Julius Mkhwanazi. He is charged alongside two other law enforcement officers and three civilians for their alleged roles in the fatal incident.

A Robbery Turned Fatal

The state's case links the violence back to a warehouse heist in April 2022 where a massive haul of copper was stolen. Investigators believe Mbense was targeted after his truck was identified on surveillance footage from the crime scene.

According to prosecutor Nceba Ntelwa, a large group including police and private security descended on Mbense’s Brakpan residence. The victim was allegedly subjected to brutal torture as the group attempted to force him to reveal the location of the missing metal.

The prosecution claims that after Mbense died from the assault, his body was dumped in the Spaarwater Dam. The accused now face Schedule 6 charges including murder, robbery, and defeating the ends of justice.

The Carnival City Pact

One of the most harrowing claims involves a meeting held at Carnival City following the disposal of the body. The state alleges the group gathered there to coordinate their stories and solidify a code of silence.

Ntelwa told the court that the group agreed that the "punishment was death" for any member who dared to break ranks and cooperate with investigators. This alleged threat has complicated the legal proceedings and the state's stance on bail.

Legal Battle for Freedom

Because they are charged under Schedule 6, the burden is on Mkhwanazi and his co-accused to prove that exceptional circumstances exist for their release. The state is vehemently opposing their bail applications due to the gravity of the crimes.

The case continues to draw intense public interest, especially following prior allegations of a high-level cover-up. The hearing has been adjourned as the defense prepares to argue why the accused should not remain behind bars while awaiting trial.
